116 And the afd William Whittington by Francis Allen his attorney Cometh and defendeth the force and Injury when &c and prayeth Leave thereof to Imparle hereuntill the third Tuesday of November then next following and he hath it and the Same day is Given to the afd William Hook and Comfort his wife here also &c Att which day here Came againe as well the afd William Hook and Comfort his wife as the afd William Whittington by their attorneys aforesaid and whereupon the same William Whittington prays further Leave thereof to Imparle hereuntill the third Tuesday of March then next following and he hath it and the Same day is given to the afd William Hook & Comfort his wife here also &c Att which day here Came againe as well the af.d W.m Hook and Comfort his wife as the af.d William Whittington by their attorneys af.d and Whereupon the same W.m Whittington prays further Leave thereof to Imparle hereuntill the third tuesday of June then next following and he hath it and the same day is given to the af.d W.m Hook & Comfort his wife here also &c Att which day here Came againe as well the af.d William Hook and Comfort his wife as the af.d William Whittington by their attorneys af.d and whereupon the same to William Whittington prays further leave thereof to Imparle her untill the third tuesday of August then Next following and he hath it and the same day is given to the af.d William Hook and Comfort his wife here also &.c Att which day here Came againe the aforesaid William Hook and Comfort his wife by their attorney aforesaid and whereupon the Same William and Comfort pray that the afd William Whittington to their declaration afd May answer but the Same Will.m Whittington altho' Solemnly Called cometh not nor saith nothing in barr or preclusion of of the action afd of the afd William Hook and Comfort his wife by which the Same William and and Comfort remaineth against the afd William Whittington thereof undefended For which reason the Same William Hook and Comfort his wife their Damages by occasion of the Nonperformance of the promise and assumption afd against the afd William Whittington ought to recover but because it is now known unto the Justices of his Lordships County Court of Somerset here what damages the Same William Hook and Comfort his wife in that part hath Sustained Therefore it is Commanded the Sheriffe of Said County that by the Oath of Honest and Lawfull men of his bailywick or Can he diligently Enquire what damages the Same William Hook and Comfort his wife hath Sustained as well by occasion of the Non performance of the promise |
