116 William Whittington on Consideration thereof afterwards to wit the day and year af.d at the County af.d upon himself did assume and to the said George in his life time then and there faithfully promise that he the said William Whittington when he should be afterwards thereto required well and faithfully would pay to the said George as much money as the said last mentioned Cow and Calf and the said last named barren Cow were reasonably worth and the af.d William Hook and Comfort say that the said last named Cow and Calf and barren Cow were reasonably worth the sum of three pounds fourteen shillings Curr.t money of maryland of which the said Whittington by the said George in his life time afterwards to witt to witt the day and year af.d at the County af.d had nottice Nevertheless the said William Whittington his severall promises and assumptions af.d in form af.d nothing regarding but minding and fraudulently intending the said George in his lifetime and the af.d William Hook and Comfort since the death of the said George Craftily and Subtily to deceive and defraud the said Severall sums above named or any part thereof to the said George in his life to the said William Hook and Comfort since the death of the said George hath not paid or him her or them or either of them for the same in any sort Contented but that to doe hitherto hath altogether refused and still doth refuse altho' thereto by the said George afterwards to wit the day and year ^afd^ at the County af.d and often since that time required and also by the said Comfort after the death of the said George while she was sole and before espousals between her and the said William Hook celebrated to wit on the first day of may Anno Dom MDCCXXXIII at the County af.d and often afterwards required and altho' also by the said William Hook and Comfort after their Interrmage to witt on the fifteenth day of June Anno Dom MDCCXXXIV at the County af.d and often since that time the said William was thereto required Whereupon the said William and Comfort say they are damnifyed ten pounds Currant money of Maryland and thereof they bring suit &c And the said William Hook and Comfort his wife brings into Court here the testamentary letters of the said George in due form of law to the said Comfort while she was sole granted which testify the said Comfort to be Executrix of the testament and last will of the said George and thereof to have administration Pledges &c John Doe & R Roe |
