115 And hereupon the said William Hook and Comfort his wife declared against the afd William Whittington in the plea afd in form following Somerset ss.t William Whittington late of Somerset County Gentleman was attached to answer unto William Hook and Comfort his wife Executrix of the testament and last will of George Taylor of a plea of trespass upon the Case &.c And Whereupon the said William Hook and Comfort by Geo Douglas their attorney complain that whereas the said William Whittington on the tenth day of November Anno Dom seventeen hundred and twenty seven at Somerset County af.d within the Jurisdiction of this Court was Indebted to the said George Taylor in his life time in the sum of three pounds fourteen shillings Curr.t money of Maryland for one Cow and Calf and one barren Cow by the said George in his life time to the said William Whittington at the especiall request and Instance of the said Whittington fo before that time sold and delivered and being so thereof indebted afterwards viz.t the day and year af.d at the County af.d upon himself did assume and to the said George in his life time then and there faithfully promise that he the said ^William^ Whittington the said three pounds fourteen shillings Curr.t money of Maryland when he should be afterwards thereto required to the said George he would faithfully pay and Content and Whereas the af.d Whittington afterwards viz.t the day and year af.d at the County af.d was Indebted to the said George in his life in other three pounds fourteen shillings Curr.t money of Maryland for the like sum of three pounds fourteen shillings Curr.t money of Maryland by the af.d William Whittington of the said George in his life ^time^ had and received and being so thereof Indebted on Consideration thereof afterwards to wit the day and year af.d at the County af.d upon himself did assume and to the said George in his life time then and there faithfully promise that he the said William Whittington the said last mentioned three pounds fourteen shillings Currt money of Maryland when he should afterwards be thereto required he would faithfully promise pay and Content and whereas the said William Whittington afterwards to witt on the day and year af.d at the County af.d did buy and receive of the George Taylor in his life time one other Cow and Calf and one ^other^ barren Cow he the said William |
