113 hundred and thirty six to answer unto Richard Knight of a plea of trespass upon the Case &a and that thereof he should not fail &a Att which day here Came before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said Richard Knight by George Douglas his attorney & the Sheriff of the Same County to witt Joseph MccClester Gent at the same day here returned that he had taken the afd Peter Taylor & Sarah his wife whose bodies hereat this day he had ready to answer unto the afd Richard Knight of the afd plea as to him it was Commanded And hereupon the said Richd declared against the afd Peter Taylor and Sarah his wife in the plea afd in form following Somerset ss Peter Taylor Late of Somerset County Gent and Sarah his wife lately Called Sarah Stewart of Somerset County widdow admrx of all and Singular the goods and Chattells rights and Creditts which were of John Stewart late of Somerset County Merchant dec.d at the time of his death died Intestate as tis said was attached to answer unto Richard Knight of a plea of trespass upon the Case &a And whereupon the said Richard Knight by George Douglas his attrny complains that whereas the said John Stewart in his life time to witt on the first day of march Anno Dom seventeen hundred and thirty two at Somerset County af.d within the Jurisdiction of this Court was Indebted to the said Richard in the sum of fourteen pounds one shilling and eleven pence half penny Curr.t money of maryland for work and service by the said Richard for the said John in his life and at the especial request and Instance of the said John before that time done and performed and for sundry other matters and things properly lying in account as by an account thereof hereto annexed may appear and so being thereof indebted in Consideration thereof afterwards in his lifetime to wit the day and year af.d at the County af.d upon himself did assume & to the said Richard then and there faithfully promise that he the said John the said fourteen pounds one shilling and eleven pence half penny to the said Richard when he should be afterwards thereof required well and faithfully he would pay and Content and alth altho the said John afterwards in his lifetime did pay to the said Richard the sum of eight pounds one shilling and eleven pence half penny Nevtheless as to six pounds seven pence half penny Curr.t money af.d Residue of the said fourteen pounds one shilling & eleven pence half penny the said John in his life his promise and assumption af.d in form af.d made nothing regarding but minding and fraudulently intending the said Richard in that part craftily to deceive and defraud the said six pounds and seven pence |
