113 Att Which day here came againe as well the afd William Rogers as the afd Thomas Lambden by their attorneys afd and whereupon the Said Thomas Lambden prays further Leave thereof to Imparle hereuntill the third Tuesday of August then next following and he hath it & the same day is Given to the afd William herealso &c Att which day here Came againe as well the afd William Rogers as the afd Thomas Lambden by their attorneys afd and whereupon the said Thomas Lambden as before defends the force and Injury when &.c and Saith that he did not assume upon himself in such manner and form as the afd William Rogers above against him hath Complained and of this he putts himselfe upon the Country and the said Thomas prays that the afd William may reply to the plea of him the said Thomas Whereupon it is paid by the Court ^here^ to the Same William that he reply to the same plea and Enter the Issue in the plea afd Immediately at his perill and afterwards at the same day Came the said Thomas Lambden by his attorney afd and the afd William altho' Solemnly Cometh not nor to the plea of the afd Thomas did reply nor is his writt afd against the same Thomas further prosecuted Therefore it is Considered by the Court here that the afd William Rogers take nothing by his writt afd but that he and his pledges of Prosecuting to witt John Doe and Richard Roe be in mercy and that the afd Thomas Lambden goe thereof without day &.c and further it is Considered that the afd Thomas Lambden recover against 25 the afd William Rogers pounds of tobacco for his Costs 25 and Charges by him about his defence in that part Sustained to the same Thomas by the Court here according to the form of the Statute in such Case thereof Lately made and provided adjudged and the same Thomas have thereof Execution &c
were of John Stewart Late of Somerset County merch.t dec.d at the time of his death who died Intestate as 'tis said if they Should be found In his bailywick and them Should safe keep so that he might have their body's before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August Anno Dom One thousand Seven hundred |
