Virg.a York County ss.t  Cap.t William Rogers this
day made oath before me that the sum of nine pound
fifteen shillings as appears by the with Acc.t is justly
due to him from Thomas Lambden of Somerset County
in maryland and that he has rec.d no satisfaction for the
same    wittness my hand this 12.th day of June 1736

  Whereupon Came hereinto Court before his Lordships
Justices at Dividing Creek John Henderson of Somerset
County planter in his proper person and undertook
for the same Thomas Lambden and assumed upon himselfe
Likewise the Same Thomas Lambden present herein Court in his proper person assumed upon
himselfe) that if it Should happen that Judgment in the plea aforesaid should be rendered
for ^the^ same William Rogers against him the said Thomas Lambden or that he the same Thomas should
be therein Convicted that than he the said Thomas should pay and satisfie unto the said William
the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the
prison of the Sheriffe of the County afd there to remaine untill the Same Judgment be fully satisfied
or that he the said John Henderson will do the same for him

             And whereupon the said Thomas Lambden prays that the afd William Rogers may give security
for Costs in Case nonsuit be Obtained against him in the plea afd which is by the Court here Granted

    Thereupon Francis Porter of Somerset County planter present herein Court in his proper person
undertakes for the said William Rogers that in Case he be nonsuited in the plea afd or otherwise
Legally Cast that than the said William Rogers shall pay the Condemnation of the Court thereupon and all
Costs accrewing thereon to the said Thomas Lambden or that he the said Francis Porter will do the same
for him
                And the said Thomas Lambden by Francis Allen his attorney Cometh and defendeth
the force and Injury when &.c and prayeth Leave thereof to Imparle hereuntill the third Tuesday
of Nove^mber then^ next following and he hath it and the same day is Given to the afd William here also &c

          Att which day here Came againe as well the afd William Rogers as the afd Thomas Lambden
by their attorneys afd  And Whereupon the same Thomas Lambden prays further Leave thereof to Imparle
hereuntill the third Tuesday of March then next following and he hath it and the same day
is given to the afd Thomas Lambden here also &c

    Att Which day here Came againe as well the afd William Rogers as the afd Thomas Lambden
by their attorneys afd and whereupon the same Thomas Lambden prays further Leave thereof to
Imparle hereuntill the third Tuesday of June then next following and he hath it and the same day
is Given to the afd Thomas Lambden here also &c
