of the afd plea as to him it was Commanded      And hereupon the said William Rogers
declared against the afd Thomas Lambden in the pea afd in form following   Somerset ss.t

    Thomas Lambden late of Somerset County Merchant was attached to answer unto
William Rogers of a plea of trespass upon the Case &c

And Whereupon the said William by Geo Douglas his attorney complains that
whereas the said Thomas on the twenty forth day of August Anno Dom seventeen
hundred and thirty three at york to wit at Somerset County af.d within the Jurisdiction
of this Court was indebted to the said W.m in the sum of nine pounds fifteen shillings
Currant money of Verginia of the value of eighteen pounds Curr.t money of
Maryland for sundry goods and Merchandise by the said W.m to the said Tho.s
and at the request and Instance of the said Thomas before that time sold and
delivered as by an account unto Court brought and hereto annexed may appear
and so being thereof indebted on Consideration thereof upon himself did assume
and to the said William then and there faithfully promise that he the said Thomas
the said nine pounds fifteen shillings Curr.t money of verginia of the value af.d
when he should be afterwards thereof required would faithfully pay and Content

Nevertheless the said Thomas his promise and assumption af.d in form af.d
mad nothing regarding but minding and fraudulently intending the said William in
that part to deceive and defraud the said nine pounds fifteen shillings Currant money
of verginia of the value af.d to the said William hath not paid but the same to him
to pay hitherto hath refused and still doth refuse altho that to doe afterwards to wit on
the day and year last af.d and often afterwards at the County af.d and within the af.d Jurisdiction
the said Thomas by the said William was required whereupon he says he is the
worse thirty pounds Curr.t money of maryland and thereof he brings suit &c
