110 Justices of Goal delivery afd afterwards to witt at a County Court of his Lordship the Lord proprietary at dividing Creek held for the County of Somerset the third Tuesday of November one thousand Seven hundred & thirty Six before Robert King Gent and others his associates Justices of his said Lordship sent the afd Indictment herein Court of Record in due form of Law to be determined Thereupon it is Commanded the Sheriff of the County afd that he should take the afd James Duffey if he Should be found in his Bailywick & him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of March Ann Dom One thousand Seven hundred and thirty Six to answer unto his said Lordship of and Concerning of the felony afd &c Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the afd James Duffey in his proper person under Custody of Joseph Macclester Gent Sheriffe of the County afd in whose Custody for the Cause afd before that time was Committed and to the barr here led and being Instantly asked how he of the felony afd in the Indictment afd above specified would thereof acquitt himselfe the Same James Duffey says that he is not thereof Guilty and thereof ^of^ Good and Evill puts himselfe upon the Country and William Goldsborough Gent his Lordships attorney and who for his said Lordship in this behalfe prosecuteth Likewise Thereupon Command is Given to the Sheriffe of Somerset County that he Should Cause to Come here before the Justices of his Lordships County Court afd ^to be held^ at dividing Creek the third Tuesday of June then next following twelve &.a who &.c to recognize &a because as well &.a and the Same day is Given to the afd James Duffey under Custody of the Sheriffe of the County afd and in the Interim the Same James Duffey is Committed into the Custody of the Same Sheriffe to be by him safely kept untill &a Att which day Cometh before the Justices of his Lordships County Court of Somerset at dividing Creek Cometh the afd James Duffey under Custody of the Sheriffe of the County afd to the barr here Led in his proper person and the Sheriffe sends not thereof his writt &.a Therefore as before it is Commanded the Sheriffe of the County afd that he should Cause to Come here before the Justices of his Lordship County Court of Somerset to be held at dividing Creek the third Tuesday of August then next following Twelve &a who &.a to recognize &a becaus as well &.a and the same day is Given to the Same James Duffey under Custody of the Sheriff of the County afd &.a and in the Interim the Same James Duffey is Commited into the Custody of the Same Sheriffe to be by him safely kept untill &a Att which day before the Justices of his Lordships County Court of Somerset at dividing Creek Came the afd James Duffey under Custody of John Henry Gent sheriffe of the County afd to the barr |
