110 barr to the barr here Led in his proper person and the Jurors of that Jury afd by the Sheriffe of the County afd to this Impannelled being Called Came to witt Edmond Hough Joshua Caldwell Thomas Perkins Alexander Lackie Samuel Long Robert Collier John Roach John Gosline John Atkinson William Turpin Robert Mitchell and James Neirne who to say the truth of and upon the premises being Elected tryed and Sworn upon their Oath Say that the Same James Duffey is not Guilty of the felony in the Indictment afd above specified in manner and form as the afd James Duffey above above by pleading alledged Whereupon all and singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the afd James Duffey be quiet and goe thereof without day &.a and whereupon the said James Duffey is ordered to give security for the payment of the Severall Officers their fees due upon the Indictment afd but for want thereof the said James Duffey is Committed into the Custody of the Sheriffe of the County afd thereto remaine untill &.a
Creek the third Tuesday of August ann Dom One thousand Seven hundred and thirty Seven to answer unto answer unto Mr Tench Francis of a plea of trespass upon the Case &.a and that thereof he Should not fail &.a Att which day here before the Justices of his Lordships County Court of Somerset at dividing Creek Came the said Tench Francis by William Goldsborough his attorney and the Sheriffe of the same County to witt John Henry Gent at the same day here returned that he had taken the afd Nicholas Fountain whose body hereat this day he had ready to answer unto the afd Tench Francis of the afd plea as to him it was Commanded And hereupon the said Tench Francis declared against the afd Nicholas Fountain in the plea afd in form following Somerset sst Nicholas Fountain Jun.r Late of Somerset County planter was attached to answer unto Mr Tench Francis of a plea of trespass upon the Case &a And Whereupon the Same Tench ^by^ William Goldsborough his attorney Complaineth that whereas the af.d Nicholas after the first Day of May in the Year of our Lord God seventeen hundred and five to wit the twenty eighth Day of September Ann Dom seventeen hundred thirty and four at Somerset County af.d did draw his certain Note in Writing Called a promissory Note with his proper hand subscribed bearing date the day and Year last mentioned and that note unto the said Tench then and there did deliver by which said note the said Nicholas did promise to pay unto the said Tench or order the sum of four pounds Current money of Value received and by |
