af.d ^in the County afd^ within the Jurisdiction of this Court one hogg of the value of one hundred pounds of tobacco of the goods and Chattels of Matthew Parrimore then and there being found then and there feloniously did steal take and bare away contrary to the peace of the said Lord proprietary that now ^is^ his good Rule and Government and against the form of the Act of assembly in such Case lately made and provided &c Test Matthew Parrimore William Jones Thomas Caldwell Elizabeth Daw on the foregoing bill of Indictment it was Endorsed viz.t A true bill WIlliam Jones foreman Thereupon Command was given to the Sheriffe of Somerset County that Should take the said John Mitchell if &c to answer &c and afterwards to witt the Fifteenth day of March anno Dom One thousand Seven hundred and thirty Six before the Justices of his Lordships County Court of Somerset now here held in the Court house at dividing ^Creek^ in the same County Cometh the afd John Mitchell according to a Certain recognizance by him and his Security by them in that part first made in his proper person under Custody of Joseph MccClester Gent Sheriffe ^of ye County afd^ into whose Custody before that time for the Cause afd was Committed to the bar ^now^ here Led and being Instantly asked how he of the felony in the Indictment afd specified above upon him Imposed would be acquitted says that he in noe sort is guilty thereof and thereof of good & Evill puts himself upon the County Therefore Immediately came thereof the Jury before the Justices of his Lordships County Court of somerset now here held in the Court house at dividing Creek in the same County this Instant Fifteenth day of March by which &c and who &c to recognize &c because as well &c and the same day is given to the afd John Mitchell under Custody of the Sheriffe and the Jurors of that Same Jury by Joseph MccClester Gent sheriffe of the County afd to this being Impannelled being Called Likewise Came to witt Nicholas Fountain Joshua Sturges Charles Townsend Joseph Houston Robert Mitchell Richard Chambers William Mumford Moses Driskill John Williams John Shiles John Peden James Jones who to say the truth of the premisses being Elected tryed and Sworn say upon their Oath that the afd John Mitchell is not Guilty of the feloney & trespass afd upon him in form afd Imposed in manner and form as by the Indictment afd above against him supposed Whereupon all and Singular the premisses by the Court here seen heard and fully understood therefore |
