1736 11 Therefore it is Considered that the aforesaid John Mitchell of the feloney afd be quiet and goe thereof without day &c Elizabeth Day appears to her recognizance to give Evidence against John Mitchell & is discharged therefrom &c Thomas Caldwell appears according to his recognizance to give Evidence against John Mitchell & is discharged therefrom &c Mathew Paramore appears according to his recognizance to give Evidence against John Mitchell and is discharged therefrom &c
And Whereupon the same John by William Beckingham his attorney complains that whereas the af.d Ebenezar the first day of may in the year of our Lord seventeen hundred and thirty five at Somerset County in his life time was Indebted unto the af.d John in the sum of twenty one pounds and five pence Curr.t money being for sundry goods wares and Merchandise by the af.d John to the ^af.d^ Ebenezer in his life time there before that time at his especiall Instance and Request sold & delivered and so thereof being Indebted the same Ebenezer in Consideration thereof afterwards to witt the day and year af.d at the County af.d upon himself did assume and to the same John then and there faithfully did promise that he the same Ebenezar the same twenty one pounds and five pence to the same John when thereof afterwards he should be required well and faithfully would pay and Content Nevertheless the af.d Ebenezer in his life time and the af.d Elizabeth the Executrix whilst sole and the af.d Elgate and Eliz.a since the Espousals between them had and celebrated the promise and assumption of the af.d Ebenezar in his life time so as af.d made in no sort regarding but minding and fraudulently Intending the same John in this part to deceive and defraud the same sum of twenty one pounds and five pence the same Ebenezer in his his life time or the af.d Eliz.a whilst sole or the af.d Eliz.a and Elgate since the Espo^u^sals between the Espousals between them Celebrated or either of them have not paid or him for the same in any sort contented altho often thereunto requested particularly the same Ebenezar in his life time on the second day of May in the year af.d and the af.d Eliz.a and Elgate since the Espousals between them celebrated but the same to him to pay or for the same in any sort to Content the same Ebenezer in his life time and the af.d Eliz.a whilst sole and the af.d Eliz.a & Elgate since the Espousals between them Celebrated have not or hath either of them paid but the same to him to pay the same Ebenezer in his life time altogether hath refused and the |
