1737 109 turff and Delivered him as possesion of the said Land and further saith not Edm.d Dickerson Senr Edmund Dickerson Sen.r aged seventy six years or there abouts being first duely Sworn on the Holy Evangelist of Almighty God (on the Behalfe of Charles Dickerson who appears as defend.t) by us the said Commissioners deposeth and Saith that he this deponant with Daniell Donohoe did walk to the tree now in his view and the said Donohoe leaned his back ag.t the said Tree did ask this deponant if that was his tree and that deponant answered that it was his tree upon which the said Daniel Donohoe replyed againe that he Believed it was this deponants Tree upon which this deponant askt the said Donohoe why he markt the tree and the said Donohoe answered that he had Liberty to marke the tree forasmuch as he did not marke it within his this deponants Land which tree is a red Oak and this deponant further saith not his Edmond M Dickerson Sen.r marke Somerset County ss.t By Virtue of the Commission hereunto annexed to Us directed wee whose names are hereunder Written) being first duely qualified as the Law directs after due Notice Given did on the thirtieth day of July ann Dom One thousand Seven hundred and thirty Seven meet upon the Land in the same mentioned and took the severall depositions to the Same annexed which we humbly Certifie to the worshipfull the Justices of Somerset County Court In Wittness whereof we have hereunto sett our hands and Seals this 30.th day of July ann Dom 1737 Jno Scott Jn.o holdon
Before John Scott the said sum of one hundred and thirty pounds of Tobacco to be Levied of your bodys goods or Chattles Lands or tenements for the Use of ye ^said^ Joshua Caldwell in Case the said Ambross Riggin shall not pay and satisfie to the said Joshua Caldwell the said sum of one hundred and and thirty pounds of Tobacco so as af.d Recovered against him with the aditionall Cost thereon on the 10 Day of february Next Taken before me on the 3d Day of september Ann Dom 1737 John Scott Somerset County These are to Certifie whom it may Concern that on the thirtyeth day of July Ann Dom 1737 George Benston was Qualified as Constable of Monokan hundred by takeing the severall Oaths |
