102 planter the twenty third day of september Anno Dom seventeen hundred thirty and six at the parish af.d in ye County af.d and within the Jurisdiction of this Court in and upon a certain Joshua Merrill (the same Joshua Merrill then being the Constable of pocomoke hundred in the same parish and County) in the peace of God and of the said Lord proprietary and in the Execution of his Office af.d then and there being with force and arms an Assault did make and the same Joshua then and there did beat wound and evilly treat so that of his Life it was greatly despaired and other Harms to him then and there did to the great Damage^s^ of the same Joshua and against the peace of the said Lord proprietary that now is for the same Lord proprietary prayeth the advice of the Court herein the premises and that due process of Law in this part against the af.d Cornelius Dickerson and Charles Dickerson may be made to answer unto the same Lord proprietary of and upon the promises &.c And afterwards to witt this Instant third Tuesday of August Ann Dom One thousand Seven hundred & thirty seven Came here before his Lordships Justices at dividing Creek afd the afd Cornelius Dickerson and Charles Dickerson in their propersons according to acertain Recognizance by them before acknowledged and had a hearing of the Information afd who severally say that they are not thereof Guilty and of this they Severally put themselves upon the Country and William Goldsborough Gentleman his said Lordships attorney and who for his said Lordship in that part prosecuteth Likewise Thereupon Immediately Came thereof the Jury before his Lordships Justices at dividing Creek this Instant third Tuesday of August by which &.c and who &.c to recognize &.c because as well &c & the same day is given to the afd Cornelius and Charles Dickerson &.c and the Jurors of that Jury by John Henry Gent Sheriffe of the County afd to this Impannelled being Called Likewise Came to witt Edmond Hough Thomas Perkins John Pope Alexander Lackey Samuel Long Robert Collier Nehemiah Holland John Gosline William Turpin Benjamin Holland Robert Mitchell and Bowdine Robins who to say the truth of the premisses afd being Elected tryed and Sworn in manner and form as by the Information afd above upon him Imposed and the Same Jury upon their oath further say that the Same Charles Dickerson is not Guilty of the trespass and assault afd in such manner & form as by the Information afd above upon him Imposed Whereupon all and Singular the premisses by the Court here seen heard and fully understood It is Considered that the afd Cornelius Dickerson pay unto his Lordship the Lord Proprietary for |
