95 that now is his good rule and Government and against the form of the act of assembly in such Case lately made and provided &a Test Mary Riggin On the backside of the foregoing bill of Indictment ti was thus Endorsed Viz.t Billa Vera Sam.l WIllson foreman Thereupon Command was given to the Sheriff of Somerset County that he should take the said James Townsend if &.a to answer &.a and afterwards to witt the Eighteenth day of November Ann: Dom: One thousand Seven hundred and thirty five before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in the same County came the said James Townsend in his proper person according to a Certain recognizance by him and his Security in that part first acknowledged and had a hearing of the Indictment af.d and being Instantly demanded how he would acquitt himself of the premisses aforesaid above by the Indictment upon him Imposed says that of the premisses aforesaid above upon him Imposed he is guilty thereof and is willing to pay his fine for the fact af.d Whereupon all and Singular the premisses by the Court here seen heard and fully understood and mature deliberation thereupon had Wherefore it is Considered by the Justices here that the aforesaid James Townsend pay unto his Lordship the right honourable the Lord proprietary for his fine by the Court hereupon him Imposed for and by Occasion of the premisses af.d whereof in form aforesaid he is Convict thirty shillings Current money of Maryland for the use of the County af.d and that the said James Townsend be taken to satisfie his said Lordship of the fine aforesaid &.a Whereupon the said James Townsend is ordered to give Security for the payment of the Severall Officers Fees due by Occasion of the premisses af.d upon the Indictment af.d thereupon a Certain Cannon Winwright of Somerset County planter present herein Court in his proper person acknowledged himself Indebted unto his Lordship the Lord proprietary in the sum of five pounds sterling of his body Goods or Chattells lands or tenements to be made and levied to the use of the Officers of Somerset County Court that hath any right to any Fees upon the Indictment aforesaid af.d If it happen that the said Cannon Winwright do not pay and satisfie unto the Severall officers their Fees due by Occasion of the premisses aforesaid upon the Indictment aforesaid &.a Likewise the said James Townsend is ordered to give good Security to Save and keep Endempnified the Justices of Somerset County court and their Successors for the time being from all Costs Charges troubles & burthens that might accrew by means of the birth &.a of the bastard Child afd Lately begott on the body of the afd Mary Riggin &a Whereupon the aforesaid James Townsend with Cannon Winwright of Somerset County planter his Security both present herein Court in their proper persons acknowledged themselves Indebted unto his Lordship the Lord proprietary in the Sum of Twenty pounds sterling ^Each^ of their Goods and Chattells Lands and Tenements Severally to be |
