November Court           1735         (95)

Thereupon Command was given to the Sheriff of Somerset County
that he should take the said James Welsh if &.a to answer &.a and
afterwards to witt the Eighteenth day of November Ann: Dom One
thousand Seven hundred and thirty five before the Justices of his
Lordships County Court of Somerset now here held at dividing Creek
in the same County came the said James Welsh in his proper person
according to a Certain Recognizance by him and his Security in that
part first acknowledged and had a hearing of the Indictment afd
and being Instantly demanded how he would acquitt himself of the
premisses aforesaid above by the Indictment upon him Imposed
says that of the premisses aforesaid above upon him Imposed he is
guilty thereof and is willing to pay his fine for the fact af.d   Whereupon
all and Singular the premisses by the Court here seen heard and
fully understood and mature deliberation thereupon had wherefore
it is Considered by the Justices here that the aforesaid James Welsh
pay unto his Lordship the right honourable the Lord proprietary
for his fine by the Court hereupon him Imposed for and by Occasion
of the premisses af.d whereof in form aforesaid he is Convict thirty
Shillings Current Money of Maryland for the use of the County af.d
and that the said James Welsh be taken to satisfie his said Lordship
of the fine aforesaid &a

    Whereupon the said James Welsh is ordered to give Security for
the payment of the Severall officers Fees due by Occasion of the
premisses af.d upon the Indictment af.d thereupon a Certain Henry
Ballard of Somerset County Gent present herein Court in his
proper person acknowledged himself Indebted unto his Lordship
the Lord proprietary in the sum of five pounds Sterling of his
body Goods or Chattells lands or tenements to be made and levied to
the use of the Officers of Somerset County Court that hath any right
to any Fees upon the Indictment aforesaid &a

If it happen that the said Henry Ballard do not pay and satisfie
unto the Severall Officers their Fees due by Occasion of the premisses
aforesaid upon the Indictment aforesaid &.a

do present that James Townsend late of Coventry parish in the County
af.d planter the tenth day of July Ann: Dom: Seventeen hundred thirty
and five at the parish af.d in the County af.d within the Jurisdiction
of this Court did committ fornication with a Certain Mary Riggin and
of her body then and there had carnal knowledge and a bastard Child on
the body of her the same Mary then and there did beget to the high
displeasure of Almighty God to the evil Example of all others in such
Case Offending contrary to the peace of the said Lord proprietary
