and Comfort Ewell Executors as afd by their attorneys afd and the said Thomas Billing his writt afd in the
plea afd against the afd James Wishart and Comfort Ewell did not prosecute with Effect &a

             Therefore he and his pledges of prosecuting be in mercy and lett the plantiff name pledges
&a and that the afd James Wishart and Comfort Ewell Executors of the Same Solomon Ewell goe thereof
without day also it is Considered that the afd James Wishart & Comfort Ewell Recover
against the afd Thomas Billing their damages by Occasion of the premisses to One hundred and
164    Eighty Six                     pounds of tobacco to the Same James and Comfort for their Costs
and Charges in that part Sustained according to the form of the Statute thereof Lately made and
provided by the Court here adjudged &a
