64 William Mister in his proper person and thereupon he is ordered to give Security for his good behaviour and appearance at November Court next to answer &a Whereupon the said William Mister with Robert Harris of Somerset County planter both present here in Court in their proper persons acknowledged themselves Indebted unto his Lordship the Lord proprietary In five pounds Sterling Each of their severall goods and Chattells Lands or tenements to use of his Said Lordship the Lord proprietary his heirs and Successors to be made & Levied If it happen that the said William Mister do not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November next and do not answer unto his Lordships of and Concerning such matters and things as Shall be then and there objected against him on his said Lordships Behalfe and do not stand and abide the Judgment of the Court thereon and do depart the Same Court without Leave and in the mean time if he is not of the good behaviour towards his said Lordship and all his good people then &a
the said John had by the said Dely during the term of their Servitude and Your petitioner therefore desires that your worships would be pleased to grant an order for the said Hodge to deliver up the said Child and Your petitioner as in duty bound shall ever pray Jno Fortune The petition afd being read and heard it is Commanded the Sheriff of Somerset County that he Should Somons the aforesaid Robert Hodge if he Should be found in his bailywick that all Excuses sett apart he be and appear before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of August then next (and that the said Hodge have at ^the same^ Court the Child of the said Jno Fortune which he detained) to answer the petition afd &a Att which said next Court to witt the third tuesday of August being the ninteenth day of the same month anno Dom One thousand seven hundred and thirty five Came the Said Sheriff to witt Joseph MccClester Gent to whom the afd Subpena was directed Came & made return that he had Sumoned the afd Robt Hodge as by the preceipt afd he was Commanded Likewise Came here into Court as well the afd John Fortune as the afd Robert Hodge with the Child of the afd John and the petition afd being againe read and heard and fully understood and the Severall allegations as well on behalfe of the petitioner as on the part of the said Robert Hodge and what the Severall Evidences deliver upon Oath at the Barr in Relation to the premisses all which being by the Court maturally |
