(61) to Chastise and punish by fines, Ransoms, Amerciaments, forfeitures & otherwise According to the Laws Customs & directions of the Acts of Assembly afores.d so far forth as they provide & where they are silent according to the Laws Statutes & reasonable Customs of England as used and practised within this province But we will not that you proceed in any of the Cases afores.d to take life or member but that in every Such Case you send the prisoners with their Indictments & the whole matters depending before you to our Justices of assize Nisi prius & Goal delivery at the next Court of oyer & Terminer to be held for our said County be it Whensoever or Wheresoever to be holden there to be tryed And we Command you and every of you Diligently to Intend the keeping the peace Acts of Assembly Laws Customs & Statutes afores.d & all & every the premisses & that your County Court you make Inquisition & hear & determine as afores.d doing therein what to Justice appertains according to the Laws Customs & directions of the Acts of Assembly afores.d so far forth as they provide & where they are silent according to the Laws Statutes & reasonable customs of England as used and practised within this province And further We do constitute ordain and appoint you the said John Hall, Richard Tilghman, Mathew Tilghman Ward, John Rousby, Benj.a Tasker Philip Lee, John Rider, Mich.l Howard, George Plater, Edm.d Jennings & Charles Hammond Esq.rs & Robert King, John Smith Balt hundred, Will.m Stoughton, John Handy, James Dashiell, John Scott, James Martin, William Lane, Thomas Williams, Henry Ballard, David Willson, Edward Rownd, Charles Ratcliffe George Dashiell, Thomas Gilliss, Isaac Handy & Mitchell Dashiell or any three or more of you as afores.d to Issue out writts precepts process & attachments & hold plea of all actions popular & of all actions personall of what sort soever wherein the demand doth not Exceed the sum of one thousand pounds sterling or thirty thousand pounds of tobacco and all actions personall now depending before you & after Judgement Execution to award in all such Cases & actions afd According to the Laws customs & directions of the acts of assembly afores.d so far forth as they provide & where they are silent According to the Laws statutes & reasonable customs of England as used & practised within this province in which said Actions to be tryed We do constitute ordain & appoint you the said John Hall, Richard Tilghman, Mathew Tilghman Ward, John Rousby Benj.a Tasker, Phillip Lee, John Rider, Michael Howard, Geo: Plater, Edm.d Jennings & Charles Hammond Esq.rs & Robert King, John Smith, Balt hundred Will.m Stoughton, John Handy, James Dashiell, John Scott, James Martin (William |
