last will of William Planner Late of the County af.d Gent deced of a plea of trespass upon the
Case &a and that thereof he should not fail &a

    Att which said third Tuesday of March to witt the Eighteenth day of the same month Ann
Dom One thousand Seven hundred and thirty four being the day of the return of the writt af.d
came the said Thomas Williams Executor as af.d by William Beckingham his attorney and the sher
of Somerset County to whome the foregoing writt was directed Likewise cometh and maketh return
thereof to the Court here Endorsed in these words Following Cepi Corpus p Jos: McClester sher

Whereupon the said Nathaniel Horse at the prayer of the af.d Thomas Williams by his attorney
af.d is adjudged to give Speciall Bail to the action af.d thereupon a Certain Francis
Porter of Somerset County Gent present herein Court in his proper person undertook for
the said Nathaniel Horsey and assumed upon himself that if it should Happen that the
said Thomas Williams should recover Judgment in the plea af.d against the same Nathaniel
Horsey or that the same Nathaniel Horsey should be therein Convict that then he the said
Nathaniel Horsey should pay and satifie unto the same Thomas Williams the Judgment
of the Court thereupon or render his body in Execution of Such Judgment to the prison
of the sher of Somerset County in Satisfaction thereof or that he the said Francis Porter
will do the same for him &a

       Whereupon the said Nathaniel Horsey by Robert Jenckins Henry his attorney cometh
and defendeth the force and Injury when &.a and prays leave thereof to Imparle hereuntill next
Court and he hath it and the same day is given to the same Thomas Williams herealso &.a

       Att which said next Court to witt the Seventeenth day of June Ann: Dom: One
thousand Seven hundred and thirty five came againe as well the af.d Thomas Williams
Executor as af.d as the af.d Nathaniel Horsey by their attorneys af.d and thereupon the said
Nathaniel Horsey prays ^further^ Leave thereof to Imparle hereuntill next Court and he hath it
and the same day is given to the aforesaid Thomas Williams herealso &.a

But before the next Court the day which the last Imparlence was to between the
parties af.d to witt this second day of July One thousand Seven hundred & thirty five the
af.d Nathaniel Horsey produced his Lordships the right Honourable the Lord Proprietary's
writt of Habeas Corpus directed to the Justices sheriff and Clerk of Somerset County the
tenour of which writt Followeth in these words Viz.t

Maryland ss   Charles absolute Lord and Proprietary of the provinces of Maryland and
Avalon Lord Baron of Baltimore &.a  To the Justices Sheriff and Clerk of Somerset County
Greeting  Whereas a Certain Nathaniel Horsey is detained in the prison of our said County
