Command was given to the Sheriff of Somerset County that he should

taken Wrixam Crapper late of Somerset County planter if he Should be found
                               in his bailywick and him should safe keep so that he might have his body before
    the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday
    of March then next to answer unto Duncan Murray of a plea of trespass
    upon the Case &.c  And that thereof he should not fail &c

    Att which said third tuesday of March to witt the Eighteenth day of the same
    month Ann Dom one thousand seven hundred and thirty four being the day
    of the return of the said writt cometh the said Duncan Murray by Robert
    Jenckins Henry his attorney and then sheriff of Somerset County to whom
    the foregoing writt was directed Likewise cometh and maketh return thereof
    to the Court here Endorsed in these words following Viz.t   Cepi Corpus
                                                                      p Joseph McClester sher

       And the aforesaid Wrixham Crapper by Francis Allen his attorney cometh and defendeth the
    force and Injury when &.a and prays Leave thereof to Imparle hereuntill next Court and he
    hath it and the Same day is given to the afd Duncan here also &a

          Att which said next Court to witt the seventeenth day of June anno Dom One thousand Seven hundred
    and thirty five Came againe as well the afd Duncan Murray as the afd Wrixham Crapper by their attorneys
    afd and for as much as the said ^Duncan Murray^ doth not prosecute his writt aforesaid against the afd Wrixam
    Crapper      Therefore he and his pledges of prosecuting be in mercy and lett the plft name
    his pledges &a and that the afd Wrixham Crapper go thereof without day also it is Considered
    that the afd Wrixham Crapper recover against the afd Duncan Murray his damages by Occasion
164   of the premisses afd to One hundred and Sixty Four                              pounds of tobacco to
    the same Wrixham by discretion of the Justices here at his request for his Costs and Charges in that
    part Sustained according to the form of the Statute &.a by the Court here adjudged &a
