of the promise and assumption aforesaid  It is Commanded the Sheriff of Somerset
County that by the oath of Honest and lawfull men of his bailywick or County
he diligently Inquire what damages the aforesaid Joshua hath sustained as well
by Occasion of the non performance of the promisse and assumption af.d
as for his Costs and Charges by him about his Suit in that part Apposed and
the Inquision which thereupon he takes he make appear to the Justices of his
Lordships County Court of Somerset to be held at dividing Creek the third Tuesday
of August Next under his seal and the seals of them by whose oath he takes
the same Inquisition he send together with the writt thereof to him directed and
the same day is given to the aforesaid Joshua herealso &.a

Command was given to the sheriff of Somerset County that he should
take William Holland Junr late of all hollows parish
bailywick and him should safe keep so that he might have his body before
the Justices of his Lordship's County Court of Somerset to be held at Dividing
Creek the third tuesday of June then next to answer unto John Bishop Junr
of a plea of trespass upon the Case &.c  And that thereof he should not fail &c

    Att which said third tuesday of June to witt the seventeenth day of the
same month Ann Dom One thousand seven hundred and thirty five
being the day of the return of the said writt Cometh the said John Bishop
by Francis Allen his attorney and the Sheriff of Somerset County to
whom the foregoing writt was directed  Likewise Cometh and maketh return
thereof to the Court here Endorsed in these words following Viz.t

       Whereupon the said William Holland Jun.r in his Own proper person Cometh and defendeth
the force and Injury when &.a and saith that he Cannot gainsay the action aforesaid ^of the afd^ John Bishop
nor Can he say but that he did assume upon himselfe in manner and form as the afd John Bishop
above against him above against him hath Complained and as to the damage of the same John hopkins
by occasion of the premisses in that part Sustained the same William saith and Confesseth that
the afd John hath Sustained damages by occasion of the premisses beyond his Costs and Charges
by him about his suit in that part apposed to three pounds tenn Shillings Currt money of
Maryland and not more and Because the afd John denys not this but the Same allegation
                                                                                                                Confesseth
