plea aforesaid according to act of assembly in such Case made and provided &.a

Att which said third Tuesday of June to witt the Seventeenth day of the same month
Ann Dom One thousand Seven hundred and thirty five being the day of the return of
the said writt cometh the said Joshua Caldwell by his attorney af.d and the Sheriff of
Somerset County to whom the foregoing the writt was directed likewise cometh and maketh
Return thereof to the Court here Endorsed in these words Following Viz.t
Cepi Corpus declaration delivered in time                                 p Jos: Macclester Sher:

       Whereupon the said Thomas Fletcher in his proper person present herein Court in his proper person
at the prayer of the af.d Joshua Caldwell by his attorney af.d is adjudged to give Speciall
bail to the action af.d thereupon a Certain William Wye of Somerset County Gent present
herein Court in his proper person undertook for the said Thomas Fletcher and assumed upon
himself (likewise the said Thomas Fletcher present herein Court as af.d assumed upon himself)
that if in Case the said Joshua Caldwell should recover Judgment in the plea aforesaid
against the said Thomas Fletcher or that the said Thomas Fletcher should be therein
Convicted that then he said Thomas Fletcher should pay the Condemnation of the Court
thereupon or render his body in Execution of Such Judgment to the prison of the sheriff
of Somerset County in Satisfaction thereof or that he the said William Wye will do the
same for him &.a                 Whereupon the aforesaid Thomas Fletcher by Francis Allen his
attorney Cometh and defendeth the force and Injury when &.a and the Same attorney of says that he is not Inform'd
by the Same Thomas his Clyant of any answer for the Same Thomas to the aforesaid Joshua in the plea
aforesaid to be given and nothing Else thereof Says by which the Same Joshua Remaineth against the afd
Thomas thereof undefended   Wherefore the Same Joshua his damages against the afd Thomas ought to recover
but because it is not known what damages the afd Joshua hath sustained by occasion of the nonperformance
