52 Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriff of Somerset County in Satisfaction thereof or that they the said Charles Ramsey and John Lamberson or Each of them will do the same for him &.a Whereupon the said Thomas Lambden by William Beckingham his attorney cometh and defendeth the force and Injury when &.a and saith nothing in barr or preclution of the action af.d of the s.d John Atkinson by which the same John Remaineth against the af.d Thomas thereof undefended &.a Therefore it is Considered by the Court here that the aforesaid John Atkinson recover against the af.d Thomas Lambden his debt af.d and his damages by occasion of the 403 detaining of the same debt to Four hundred & Twenty Five pounds of tobacco to the same John of his assent by the Court here adjudged and the af.d def.t in mercy &.a
the Case &a And whereupon the said Joshua by Francis Allen his attorney Complaines that whereas the said Walter in his Lifetime to witt the twenty fifth day of December anno Dom seventeen hundred and thirty three at Somerset County afd within the Jurisdiction of this Court was Indebted unto the said Joshua in seventeen hundred and forty one and a halfe pounds of tobacco for sundrys properly Chargable in account as by account thereof hereinto Court produced may appear and being so thereof Indebted the said Walter in his Lifetime in Consideration thereof the day and year aforesaid at the place aforesaid upon himselfe did assume and to the said Joshua then and there did faithfully promise that he the said Walter the said seventeen hundred forty one and a halfe pds of tobacco to the said Joshua when he Should bet thereunto requested well and faithfully he would pay and Content Nevertheless the said Walter in his Lifetime nor the afd James since the decease of the s.d Walter to whom admrcon of all & Singular the goods & Chattles Rights & creditts of the s.d Walters at the time of his death after the decease of the s.d Walter in due form of law was Committed the promisse & assumption afores.d of the afores.d Walter in his life time so as afores.d made nothing regarding but plotting & fraudulently Intending the s.d Joshua in that part craftilly & Subtilly to deceive and defraud the afores.d Seventeen hundred forty one & a half pounds of Tobacco to the s.d Joshua (have |
