(51) to answer unto John Atkinson of a plea that he render unto him Eighty pounds Curr.t Cash of Maryland which to him he owes and unjustly detains &a And the aforesaid John Atkinson by Francis Allen his attorney declared against the aforesaid Thomas Lambden in the plea aforesaid as Followeth Viz.t Somrsett County W Thomas Lambden late of Somrsett County Merchant al dict Thomas Lambden of Sumersett County in the province of Maryland Marchant was Sumoned to answer unto John Atkinson of a plea that he render unto him Eighty pounds Curr.t Cash of Maryland which to him he owes and unjustly detaines &.a And Whereupon the s.d John by Francis Allen his attorney saith that whereas the s.d Thomas the twenty fifth day of August Anno Dm Seventeen hundred & thirty three at the County of Somrsett afores.d within the Jur of this Court by his certain writing obligatory which the s.d John with the seal of the s.d Thomas Signed hereinto Court brings the date whereof is the same day & year did acknowledge himself to be bound unto the s.d John in the afores.d Eighty pounds to be paid unto the s.d John when he should be thereunto required yett the s.d Thomas tho' often required the said Eighty pounds to the s.d John hath not rendered but the same to him hitherto to render hath deny'd and Still doth deny and unjustly detain to the damage of the s.d John of tenn pounds curr.t money afores.d and thereupon he brings Suite &.a Pledges &.a Jn.o Doe R: Roe A Copy of the foregoing declaration was made and sent to be served on the defend.t with the writt in the plea afd according to act of assembly in such Case made and provided &.a Att which said third Tuesday of June to witt the Seventeenth day of the same month Ann: Dom: One thousand Seven hundred and thirty five being the day of the return of the said writt cometh the said John Atkinson by his attorney afd and the sher of Somerset County to whome the foregoing writt was directed likewise cometh and maketh return thereof to the Court here Endorsed in these words Following Viz.t Cepi Corpus declaration delivered in time p Jos: McClester sher Whereupon came hereinto Court the said Thomas Lambden in his proper person and thereupon at the prayer of the afores.d John Atkinson by his attorney aforesaid the said Thomas Lambden is adjudged to give Special bail to the action af.d Thereupon a Certain Charles Ramsey and John Lamberson of Somerset County planters present herein Court in their proper persons undertook and Each of them undertook for the said Thomas Lambden and assumed upon themselves (likewise the said Thomas Lambden present herein Court as af.d assumed upon himselfe) that if in Case the said Jn.o Atkinson should recover Judgment in the plea af.d against the said Thomas Lambden or that the said Thomas Lambden should be therein Convicted that then he the said Thomas Lambden should pay the Condemnation of the (Court |
