have not paid or Contented altho' the same to do the s.d Walter in his life to witt on the
afores.d twenty Fifth day of december in the year afores.d and y.e afores.d James on the
thirtieth day of July Seventeen hundred & thirty four & often afterwards at the County
afores.d by the s.d Joshua they were thereunto requested but the same to him hitherto to pay
the s.d Walter in his life time and the s.d James since the decease of the s.d Walter have
refused and the s.d James since the decease of the s.d Walter the same to the s.d Joshua to pay
still doth refuse and deny to the damage of the s.d Joshua of three thousand four hundred
pounds of Tobacco and thereupon he brings Suite &a         Pledges de p8  John Doe

This day came before me y.e Subscriber one
of his Lordships Justices of y.e peace for
Sumersett County Joshua Caldwell and made
oath on the holy Evangelist of Almighty God
that the above account as it stands stated by
y.e Severall officers lists put into his hands
to Collect are Just and true and that he
hath not Received any part or parcell
thereof more than Credit is given for nor
any Security nor satisfaction for y.e same
nor any person for his use to y.e best of
    knowledge Sworne before me this 5.th day of November 1734      Mitchell Dashiell
   
Whereupon the aforesaid James Dashiell adm.r of Walter Jacobs by Robert Jenckins
Henry his attorney cometh and defendeth the force and Injury when &.a and prays leave
thereof to Imparle hereuntill next Court and he hath it and the same day is given to the
af.d Joshua herealso &.a        Att which said next Court to witt the Seventeenth day of
June Ann: Dom One thousand Seven hundred hundred and thirty five came againe as well the
af.d Joshua Caldwell as the af.d James Dashiell Adm.r of Walter Jacobs by their attorneys
aforesaid and thereupon the said Joshua prays that the aforesaid James to his declaration aforesaid may answer
but the same James altho' Solemnly Called Cometh not nor the Same attorney of the aforesaid
James for him the same James nothing thereof Says in Barr or preclusion of the action afd of the afd Joshua
by which the same Joshua Remaineth thereof against him undefended   wherefore the same Joshua his damages
by occasion of non performance of the premise and assumption afd against the afd James adm.rs as afd
ought to recover but because it is not known what damages the afd Joshua hath sustained by occasion of
the non performance of the promise and assumption afd  It is Commanded the Sheriff of Somerset
