June Court                 1735              (51)

Att which said third Tuesday of June to witt the Seventeenth day of the same
month Ann Dom One thousand Seven hundred and thirty five being the day of
the return of the said writt cometh the said John Atkinson by his attorney af.d and
the Sheriff of Somerset County to whome the foregoing writt was directed Likewise
cometh and maketh return thereof to the Court here Endorsed in these words Following
Viz.t                  Cepi Corpus declaration delivered in time P Jos: Macclester Sher

          Whereupon Came here into Court here ^the said Thomas Lambden^ in his proper person and thereupon at the prayer of the
aforesaid John atkinson by his attorney aforesaid the said Thomas Lambden is adjudged to give Special
Bail to the action afd   Thereupon a Certain William Wye, John Britt & James Breman all of
Somerset County Gentleman present herein Court in their proper persons undertook and Each & every
of them undertook for the Said Thomas Lambden and assumed upon themselves (Likewise the said
Thomas Lambden present herein Court as afd assumed upon himselfe) that if in Case the said Jn.o
Atkinson should recover Judgment in the plea aforesaid against the said Thomas Lambden or that
the said Thomas Lambden should be therein Convicted that then he the said Thomas Lambden Should
pay the Condemnation of the Court thereupon or render his body in Execution of Such Judgmt to
the prison of the Sheriff of Somerset County in Satisfaction thereof or that they the said Wm Wye
John Britt and James Breman or Each or every of them will do the Same for him &a

          Whereupon the said Thomas Lambden by William Beckingham his attorney Cometh &
defendeth the force and Injury when &a and saith nothing in Barr or precision of the action
aforesaid of the aforesaid John Atkinson by which the same John Remaineth against the afd Tho.s
thereof undefended &a
                                           There it is Considered by the Court here that the aforesaid John
Atkinson recover against the aforesaid Thomas Lambden his debt aforesaid and his damages by
Occasion of the detaining of the Same debt to Four hundred & Twenty five
403   pounds of tobacco to the Same John of his assent by the Court here adjudged and the afd defend.t
in mercy &a

    Command was given to the Sher of Somerset County that
he should take Thomas Lambden late of Somrsett County Merchant
al dict Thomas Lambden of Sumersett County in the province of
Maryland Marchant if he should be found in his bailywick and him should safe
keep so that he might have his body before the Justices of his Lordships County
Court of Somerset to be held at dividing Creek y.e third Tuesday of June then Next
