(47) as the af.d John Aidelott by their attorneys af.d and whereupon the af.d John Aydelott prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d Thomas herealso &.c Att which said next Court the Seventeenth day of June Ann Dom One thousand Seven hundred and thirty Five came again as well the af.d Thomas Fletcher as the af.d John Aydelott by their attorneys af.d and whereupon the af.d John Aydelott as before defends the force and Injury when &.a & says that he is not Guilty of the premises by the same Thomas above upon him imposed in manner & form as the said Thomas above against him hath complained & of this he puts himself upon the Country And the aforesaid Thomas Fletcher in like manner Thereupon it is Commanded the Sheriffe of Somerset County that Immediatly he should cause to come here before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek in the County af.d Twelve &.c by whom &.c and who Neither &.c to recognize &.c because as well &.c and afterwards Immediatly came thereof the Jury &.c and the Jurors of that same Jury by Joseph M.cClester sheriffe Gent sheriffe of the County af.d to this Impannelled being called came to witt Capell King Thomas Waller Angelo Atkinson Jonathan Sturges George Benston James Breman William Mills Richard Chambers James Nairne John Lane Archibald White and Mosses Cheillie who to say the truth of the premisses aforesaid being duely Elected tryed and Sworn upon their oath do say that the aforesaid John Adelott is guilty of the premisses in manner and form as the afd Thomas Fletcher above against him hath Complained and assessed the damages of the same Tho.s by Occasion of the premisses afd further than his Costs and Charges b him about his Suit in that part apposed to Seven pounds Eight Shillings and Seven pence halfe penny Currant money of maryland and for those Costs and Charges to One pound of tobacco Therefore it is Considered by the Court here that the afd Thomas Fletcher recover against the aforesaid John Aidelott his damages aforesaid by the Jurors afd in form afd 723 assessed as also Seven hundred and fifty One pounds of tobacco for his Costs and Charges aforesaid to the Same Thomas by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount to Seven pounds Eight Shillings and seven pence halfe penny Curr.t money of maryland and seven hundred and fifty One pounds of tobacco and the afd defend.t in mercy &a
