	June Court 1735 (47) And whereupon the s.^d John by Francis Allen his attorney complains that whereas y.^e s.^d Benjamin in his life time to witt y.^e ninth day of March Anno Dom Seventeen hundred & thirty three at the County of Som^rsett afores.^d within the Jur of this Court had Accounted together with him the s.^d John of Sundry Sums of tobacco & money by the s.^d John before y.^e time due owing & unpaid and upon that acc.^t the s.^d Benjamin was found in arrear to him the s.^d John in four pounds nine shillings & four pence three farthings curr.^t money of Maryland and One hundred & twenty Seven pounds of Tobacco and being so thereof Indebted the s.^d Benjamin in his life time to witt on the afores.^d ninth day of March in y.^e year afores.^d at y.^e County afores.^d in Consideration thereof upon himself did assume and to the s.^d John then & there did faithfully promisse that he the s.^d Benjamin the s.^d four pounds Nine shillings & four pence three farthings in Cash or pork at tenn Shillings per hundred & One hundred & twenty Seven pounds of tobacco to the s.^d John by the twenty Fifth day of december then next Ensuing he would well and faithfully pay & Content and whereas also the afores.^d Benjamin in his life time afterwards to witt the twenty Fifth day of June Anno Dm Seventeen hundred & thirty three at the County of Som^rsett aforesaid within the Jur of this Court was Indebted unto the s.^d John in Forty pounds of Tobacco for one Gall of Rum by the s.^d John to the s.^d Benjamin in his life time at the Special Instance & request of the s.^d Benjamin before that time there sold & delivered and being so thereof Indebted the s.^d Benjamin in his life time in Consideration thereof the day & year last afores.^d at the County afores.^d upon himself did assume and to the s.^d John then & there did faithfully promise that he the s.^d Benjamin the s.^d Forty pounds of tobacco to the s.^d John when he should be thereunto requested well & faithfully he would pay & Content and whereas also the afores.^d Benjamin in his life time to witt the twenty Fifth day of June ANno Dm Seventeen hundred & thirty three at the County aforesaid within the Jur of this Court was indebted unto the s.^d John in other Four pounds Nine shillings & four pence three farthings curr.^t money of Maryland to be paid in Cash or pork at tenn shillings p hundred & one hundred & Sixty Seven pounds of tobacco for Sundrys properly chargeable in Acc.^t as by Acc.^t thereof hereunto annexed and herein Court produced may appear and being so thereof Indebted the s.^d Benjamin in his life time in Consideration thereof the day & year afores.^d last mentioned at the place afores.^d upon himself did assume and to the s.^d John then & there did faithfully promise that he the s.^d Benjamin (the
