46 tryed and Sworn upon their Oath do say that the afd Mathew Dorman is guilty of the premisses in such maner and form as the aforesaid Robert Downs above against him hath Complained and assessed the damages of the Same Robert by occasion of the premisses afd beyond his Costs and Charges by him about his Suit in that part apposed to thirty Shilling Currant money &a Therefore it is Considered that the aforesaid Robert Downs Recover against the afd Mathew Dorman his damages aforesaid to thirty Shillings Currant mony by the Jurors aforesaid in form afd assessed 907 has also Nine hundred and Seven pounds of tobacco to the Same Robert Downs at his request for his Costs and Charges by the Court here of Increas adjudged and that the afd Mathew be taken &a
three at the County of Somerset afores.d within the Jurisdiction of this Court was possessed of two hogsheads of tobacco weighing Neat One thousand Eighty Nine pounds of the Value of tenn pound curr.t money of Maryland as of his proper Goods and Chattles and so being of the same possessed the s.d two hh.ds of tobacco out of his hands & possession casually lost w.ch s.d two hogsheads of tobacco afterwards to witt y.e afores.d fifteenth day of March in the year afores.d to the hands & possession of the s.d John by finding came nevertheless the s.d John well knowing the two hogsheads of tobacco afores.d to be of the proper goods & Chattles of the afores.d Thomas and to him the s.d Thomas of right to belong & appertain but plotting & fraudulently Intending the s.d Thomas of the afores.d two hogsheads of tobacco to defraud & deceive the s.d two hogsheads of tobacco to the s.d Thomas altho the same to do the s.d John by the s.d Thomas was often thereunto requested hath not delivered but the same two hh.ds of Tobacco afterwards to witt on the Sixteenth day of March in y.e Year afores.d to his own proper use did Convert & dispose to the damage of the s.d Thomas of twenty pounds curr.t money of Maryland And thereupon he brings suit &.c Pledges &.c Jno Doe R Roe Whereupon the said John Aydelott by George Douglas his attorney cometh and defendeth the force and Injury when &.a and prayes leave thereof to Imparle hereuntill next Court and he hath it and the same day is Given to the af.d Thomas herealso &.a Att which said next Court to witt the Eighteenth day of March Ann Dom One thousand Seven hundred and thirty four came again as well the af.d Thomas Fletcher (as |
