(46) the said Robert did ride & immoderately use & work by the Space of thirty days & other harms to him did to the Great damage of the said Robert & against the peace of the Right honourable the Lord Proprietary his good Rule & Government &.a And Whereupon the said Robert by Geo: Douglas his attorney complains that the aforesaid Mathew Dorman on the twenty fifth day of June Ann Dom Seventeen hundred & thirty four at Somerset County af.d within the Juris of this Court with force & arms one horse of the price of ten pounds Current money of Maryland of the Goods & chattles of the said Robert did take & the said horse against the will & Consent of the said Robert did ride & immoderately use and worke by the Space of thirty days that is from the said twenty fifth day of June in the year af.d to the twenty fifth day of July then next Ensuing & other harms to him then & there did to the great damage of the said Robert & against the peace of the right honourable the Lord proprietary his good rule & Government whereupon the said Robert says he is damnify'd twenty pounds Current money of Maryland & thereof he brings suit Pledges &c Jn.o Doe & R.d Roe Whereupon the said Mathew Dorman by Francis Allen his attorney cometh and defendeth the force & Injury when &.a and prays leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d Robert herealso &a Att which said next Court to witt the Eighteenth day of March Ann Dom One thousand Seven hundred and thirty foure came again as well the af.d Robert Downs as the af.d Mathew Dorman by their attorneys af.d and whereupon the af.d Mathew Dorman prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the af.d Robert herealso &.c Att which said next Court to witt the Seventeenth day of June Ann Dom One thousand Seven hundred and thirty five came againe as well the af.d Robert Downs as the af.d Mathew Dorman by their attorneys af.d and whereupon the said Mathew Dorman as before defends the force and Injury when &.a and saith that he of the prmisses afores.d above upon him Imposed is not Guilty in manner & forme as the s.d Robert above ag.t him hath complained and of this he puts himself upon y.e Country &.a and the plft Likewise Thereupon it is Commanded the sheriff of Somerset County that Immediatly he should cause to come here before the Justices of his Lordships County COurt of Somerset now sitting at dividing Creek in the County af.d twelve &.a by whom &.a ^and^ who neither &.a to recognize &.a because as well &.a and afterwards Immediately came thereof the Jury &.a and the Jurors of that same Jury by Joseph McClester Gent sheriff of the County af.d to this Impannelled being called came to witt Day Scott John Waters Thomas Waller Angello Atkinson Jonathan Sturgis George Benston James Breman Wm Mills Rich.d Chambers James Nearn John Lane and Archibald White who to say the truth of the premisses afd being duely Elected tryed |
