45 and whereupon the said William Jones prayes further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the aforesaid John here also &c Att which said next Court to witt the Seventeenth day of June anno Dom one thousand seven hundred & thirty five Came againe as well the aforesaid John Rider as the afd William Jones by their attorneys aforesaid and whereupon the said William Jones as before defends the force and Injury when &c and Saith that he did not assume upon himselfe in manner and form as the said John above against him hath Complained and of this he putts himselfe upon the Country and the plft also Thereupon it is Commanded the Sheriffe of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now Sitting at dividing Creek in the County afd twelve &a by whom &a and who neither &a to recognize &a because as well &a and afterwards Immediately came thereof the Jury &.a and the Jurors of that same Jury by Joseph MccClester Gent sherriff of the County aforesaid to this Impannelled being Called Came to witt Day Scott William Holland John Waters Thomas Waller Angello atkinson Jonathan Sturges Geo: Benston James Breman W.m Mills Richard Chambers James Nearn & John Lane who to say the truth of the premisses afd being duely Elected tryed and Sworn and from the Barr of which Court of their Verdict of and upon the premisses afd to Render between themselves to Commune together did recede and afterwards to the Same Barr for their Verdict in that part to render did return whereupon the aforesaid John Rider altho Solemnly Called Came not but made default nor is his writt aforesaid further prosecuted &a Therefore it is Considered by the Court here that the aforesaid John Rider take nothing by his writt and declaration aforesaid but that he and his pledges of prosecuting to witt John Doe and Richd Roe be thereof in Mercy and that the afd William Jones go thereof without day &.a and further it is Considered that the aforesaid William Jones Recover against the said John Rider five hundred & Seventy One 571 pounds of tobacco for his Costs and Charges by him about his defence afd in that 573 part Sustained to the Same William Jones here according to the form of the Statute in such Case thereof Lately made and provided adjudged and that the afd William Jones have thereof Execution &a
