1735 42 the aforesaid Joseph in the af.d sum of Eighteen pounds four Shillings Current money to be paid unto the same Joseph when thereof afterwards he should be required Nevertheless the af.d Michael altho often required the af.d sum of money unto the af.d Joseph hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same Joseph thirty pounds Current money and one thousand pounds of tobacco And thereupon he brings Suit &cra And doth bring here into Court the writing obligatory af.d which the debt afd in form af.d doth testifie the date whereof is the same day and year af.d &cra pledges &cra Jno Doe & Richard Roe And the aforesaid Michael Morriss by William Beckingham his attorney Cometh and defendeth the force and Injury when &.a and saith that he Cannot gainsay the action aforesaid of the aforesaid Joseph Ennalls nor Can he Say but that the writing Obligatory ^afd^ is the deed of him the Same Michael nor but that he Oweth the same Joseph the aforesaid Eighteen pounds four Shillings Curr.t money in manner and form as the afd Joseph above against him hath declared whereupon the same Joseph prays Judgmt for his debt aforesaid and his Costs and damages sustained by Occasion of the detaining of that same debt to him to be adjudged &a Therefore it is Considered by the Court here that the aforesaid Joseph Ennalls recover against the aforesaid Michael Morriss his debt aforesaid and his Costs and damages Sustained by occasion 299 of the detaining of the Same debt to Two hundred and Ninty Nine pounds of tobacco to the Same Joseph of his assent by the Court here adjudged and the aforesaid defend.t in mercy &a
render unto the same Samuel Eleven hundred Sixteen pounds of good sound merchantable leaf tobacco which from him he unjustly detains &.c And whereupon the same Samuel by William Goldsborough his attorney saith that whereas the aforesaid Charles the Eleventh day of November which was in the Year of our Lord God Seventeen hundred and thirty four at Somerset County af.d by his certain writing obligatory had granted himselfe to be bound unto the af.d Samuel in the af.d sum of Eleven hundred Sixteen pounds of good sound merchantable leaf tobacco to be paid unto the (same |
