(40) Ramsey and assumed upon themselves (Likewise the said Charles Ramsey assumed upon himselfe) that if in Case the said Robert Mccfarline should recover Judgement in the plea af.d against the said Charles Ramsey or that the said Charles Ramsey should be therein Convicted that then he the said Charles Ramsey should pay the Condemnation of the Court thereupon or render his body in Execution of such Judgm.t to the prison of the Sher of Somerset County in satisfaction thereof or that he the said ^Thomas Lambden^ John Ramsey will do the same for him &.c Whereupon the said Charles Ramsey by George Douglas his attorney Comes and defends the force and Injury when &.c and prays that the aforesaid Robert Mccfarline may give security for Costs according to act of assembly in such Case made and provided in Case that he ^be^ Nonsuited in the plea afd or otherways Legally Cast which is by the Court granted &c whereupon the aforesaid Robert Mccfarline ^being^ Solemnly Called cometh not nor is his writt aforesaid against the said Charles Ramsey further prosecuted &a Therefore he and his pledges of prosecuting be in mercy and Lett the plft name pledges &.a and that the aforesaid Charles Ramsey goe thereof without day also it is Considered that the aforesaid Charles Recover against the aforesaid Robert his damages by Occasion of the premisses to Two hundred 196 and Eighteen pounds of tobacco to the Same Charles by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute &.c by the Court here adjudged &c
