Therefore by Consent of the parties af.d it is Considered by the Court here that the af.d
Joshua Caldwell Recover against the af.d Dennis Driskill his damages afd to the af.d
fourteen hundred and Eight pounds of tobacco in forme af.d Confessed as also two hundred
263   and Sixty three                     pounds of tobacco for his Costs and Charges af.d to the
same Joshua by the Court here and Consent of the parties af.d adjudged and the af.d
defendant in Mercy &.c

Command was Given to the sheriff of Somerset County that he should
take James Breman late of Somerset County planter if he should
be found in his bailywick & him should safe keep so that he might have
his body before the Justices of his Lordships County Court of Somerset to be
held at dividing Creek y.e third Tuesday of June then Next to answer unto Alexander ^Buncle^ of
a plea of trespass upon the Case &.c and that thereof he should not fail &.c

And the af.d Alexander Buncle by George Douglas his attorney complained against the said
James Breman in the plea af.d as Followeth Viz.t

Sommerset ss  James Breman late of Sommerset County planter was attached to answer
to Alexander Buncle of a plea of trespass upon the Case &.c

And Whereupon the said Alexander by Geo: Douglas his attorney complains that
whereas the said James on the first day of April Anno Domi Seventeen hundred & thirty
five at Sommerset County within the Juris of this Court was indebted to the said Alexander
in the Sum of fourteen pounds Eighteen shillings and four pence Current money of
Maryland for Sundry wares & Merchandize & other matters and things properly lying in
Account as by an Account thereof herewith into Court brought & hereto annexed may
appear and the said James being so thereof indebted on Consideration thereof upon himself
did assume & to the said Alexander then & there faithfully promise that he the said
James the said fourteen pounds Eighteen shillings & four pence Current money of Maryland
when he should be afterwards thereof Required to the said Alexander would faithfully
^pay^ & Content  Nevertheless the said James his promise & assumption af.d in form af.d
made nothing regarding but minding & fraudulently intending the said Alexander
in that part craftily & Subtilly to deceive & defraud the said fourteen pounds
Eighteen Shillings & four pence Current money of Maryland to the said Alexander
hath not hitherto paid or him for the same in any sort contented but the same
to him to pay hath altogether refused & still doth refuse altho the same to doe
the said James afterwards to witt the day and year af.d at the County af.d &
often since that time by the said Alexander was required  Whereupon the said
