minding & fraudulently intending the said Joshua in that part craftily & subtilly
to deceive & defraud the said fourteen hundred & Eight pounds of tobacco Residue of
the said fifteen hundred & Eighty three pounds of tobacco to the said Joshua hath not paid
or him for the same in any sort contented but the same to him to pay hath altogether
refused & still doth refuse altho the same to doe the said Dennis afterwards to wit
the day & year afd at the County afd & often Since that time was required by the
said Joshua whereupon the said Joshua says he is damnifyed three thousand pounds

the sheriff of Somerset County to whome the foregoing writt was directed  Likewise
cometh & maketh Return thereof to the Court here Endorsed in these words Following Viz.t
Cepi Corpus declaration delivered in time                                                      p Jos: Macclester sher

Whereupon the aforesaid Dennis Driskill in his own proper person cometh and
defendeth the force and Injury when &.c and saith that he cannot Gainsay the action af.d
of the af.d Joshua Caldwell nor can he say but that he did assume upon himselfe in
manner and forme as the af.d Joshua Caldwell above against him hath complained
and as to the damage of the same Joshua by him Occasion of the premisses in that
part Sustained the same Dennis Driskill saith and Confesseth that the af.d Joshua
Caldwell hath Sustained damages by Occasion of the premisses beyond his Costs
and Charges by him about his suit in that part apposed to fourteen hundred & Eight
pounds of Tobacco and not more and because the af.d Joshua deny's not this but
the same allegation Confesseth to be true prays Judgment for those damages above
confessed together with his Costs and charges af.d to him to be adjudged &.c
