A Copy of the foregoing declaration ^& Acct^ were made and sent to be served on the def.t with the writt in the plea af.d according to act of assembly in such Case provided &.cra Att which said third tuesday of June to witt the seventeenth day of of the same Month Ann Dom one thousand Seven hundred and thirty five being the day of the return of the said Writt Cometh the said Duncan Murray by his Attorney af.d and the Sher of Somerset County to whom the foregoing Writt was directed likewise cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus declaration delivered in time P Jos: McClester Sher Whereupon the aforesaid John Bishop in his own proper person Cometh and defendeth the force and Injury when &.cr and saith that he cannot gainsay the action af.d of the af.d Duncan Murray nor can he say but that he did assume upon himselfe in manner and form as the af.d Duncan Murray above against ^him^ hath Complained and ^as^ to the damage of the same Duncan by him by occasion of the premises in that part sustained the same John Bishop saith and Confesseth that the af.d Duncan Murray hath sustained damages by occasion of the premises beyond his Costs and Charges by him Therefore by Consent of the parties aforesaid it is Considered by the Court here that the af.d Duncan Murray recover against the aforesaid John Bishop his damages af.d to the af.d fourteen pounds seven shillings and three pence Current money of Maryland in form af.d Confessed as also 386 three hundred and Eighty Six pounds of tobacco for his Costs and Charges aforesaid to the same Duncan by the Court here and Consent of the parties af.d adjudged and the af.d def.t in mercy &cra |
