June Court               1735            35

Nevertheless as to fourteen pounds seven shillings and three pence residue
of the said Eighteen pounds Eleven shillings and nine pence the said
John his promise and assumption af.d in form af.d made nothing regarding
but minding and fraudulently Intending the said Duncan in
that part Craftily and subtilly to deceive and defraud the said fourteen
pounds seven shillings & three pence to the said Duncan hitherto
hath not paid or him for the same in any sort Contented but the same
to him to pay hath altogether refused altho' thereto afterwards to witt on
the day and year af.d at the County af.d and often since that time by the
said Duncan required and the same to him to pay still doth refuse
to the damage of the said Duncan twenty nine pounds Current
money of Maryland and thereof he brings suit &.cra
