 Somerset County sst  Charles Ramsey late of Somerset County planter was
attached to answer unto William Benston of a plea of trespass upon the Case &c
And Whereupon the same William by Robert Jenckins Henry his
                                           attorney Complaineth that whereas the aforesaid Charles after the first
day of May Ann Dom Seventeen hundred and five (to wit) the twenty fourth day of
May Seventeen hundred and thirty four at Somerset County aforesaid made his
certain note in writing called a promissory note with his own proper hand thereunto
Subscribed bearing date the same day and Year last abovesaid and the Same note
then and there to the Same William did deliver by which said note the said Charles
did promise to pay to the Same William by the name of William Benston twelve
hundred good Merchantable Cypruss Boards Six Inches Broad Six hundred to be
paid by the Last of June and the Six hundred Residue by the fall in the Year seventeen
hundred thirty and four and the Same Charles afterwards and within the Severall
times or at either of them the Severall quantitys of Boards or any of them to the same
William did not pay by reason of which said promise and also by force of the Statutes
in such Case made and provided the Same Charles became Chargeable to pay to the
same William the aforesaid Twelve hundred Cypruss Boards according to the tenor of
the Same note and so being thereof Chargeable in Consideration thereof afterwards (to wit)
the Same day and Year aforesaid at Somerset County aforesaid upon himself did
assume and to the same William then and there faithfully did promise that he
the aforesaid Charles the Twelve hundred Cypruss Boards discribed as aforesaid to the
same William when he should be thereunto requested he would well & faithfully pay
and Content   Nevertheless the aforesaid Charles his promise and assumption aforesaid in
form aforesaid made nothing regarding but ploting and fraudulently Intending the same
William in that part Craftily & Subtilly ^to^ deceave and defraud the aforesaid Twelve
hundred Cypruss Boards or any of them to the same William hath not as yet paid or
to him for the Same in any sort contented altho the Same to do the said Charles
afterwards (to witt the same day Year & place last aforesaid and often afterwards
by the same William was thereunto requested but the same to him hitherto to pay or Content
the Same Charles hath altogether refused and still doth refuse and deny to the damage
of the said William three thousand Cypruss boards aforesaid and thereof he bringeth suit &.c

Whereupon the said Charles Ramsey present here in Court in his proper person is by the
same Court adjudged to give Special Bail to the Action af.d  Thereupon a Certain John
Ramsey late of Somerset County planter came hereinto ^Court^ in his proper person
and undertook for the said Charles Ramsey and assumed upon himselfe (Likewise
