316 sterling Each for their and Each of their appearances before the Justices of his Lordships County Court of Somerset to be held at Divi in the Court house at dividing Creek in the Same County the third Tuesday of June then next to give Evidence on behalfe of his Lordship against Cornelius and Charles Dickerson &c Whereupon the said Joshua Merrill Saul Townsend and Solomon Townsend all present herein Court as afd acknowledged themselves Indebted unto his Lordship the Lord Proprietary in the sum of five pounds sterling Each of the ^their^ Severall goods and Chattells Lands and tenements to the Use of his said Lordship his heirs and Successors to be made and Levied If it happen that the said Joshua Merrill Saul Townsend and Solomon Townsend and Each and Every of them do and Shall not make their personall appearance before the Justices of his Lordship County Court of Somerset to be held in the Court house at dividing Creek in the Same County the third Tuesday of June then next and do not then & there give Such Evidence as they and Each of them doe know ag.t they said Cornelius and Charles Dickerson and Each of them on behalfe of his Lordship of and Concerning their the said Cornelius and Charles Committing of an assault on him the said Joshua Merrill and doe depart the same Court without Leave &c
Court in and upon a Certain Negro Adam the slave of Benjamin Marchment of the same County planter in the peace of God and of the said Lord proprietary then and there being with force and Arms an assault did make and the same negro then and there did beat wound and evilly treat so that of his life it was much despaired and other harms to him then and there did to the great damage of the same ^Benja^ and against the peace of the said Lord proprietary that now is his good rule and Government &c Test Elizabeth Merchant On the backside of the foregoing bill of Indictment it was Endorsed viz.t True bill p William Jones Foreman Thereupon Command was given to the Sheriffe of Somerset County that he Should take the said William Conner if he Should be found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held in the Court house at dividing Creek in the Same County the third Tuesday of March then next to answer unto his said Lordship of and Concerning the Indictment afd for his Committing of the assault afd and that thereof he should not fail &c And afterwards to witt the third Tuesday of march being the fifteenth day of the Same Month ann Dom One thousand Seven hundred and thirty Six before the Justices of his said Lordships County Court of Somerset now here held in the Court house at dividing Creek in the County afd Came the said William Conner in his proper person and had a hearing of the Indictment afd and being Instantly demanded how he would acquitt himselfe of the premisses afd ^above upon him Imposed^ saith that he will not Contend with his said Lordship the Lord propry but Submits with a protestation of his Innocency and putts himselfe upon the favour of |
