March the 26 1736  Came Capt Dunkin Murrey before me one of his Lds
Jugs of the peace for Sumerset County and made Oath upon the Holy Evangelist
of almighty God that the within acco.t as it Stands stated is Just and true
and that he never Recd Part nor parcell thereof but what he hath Given
Creditt for Given Under my hand      Cha: Rackliffe

    Aprill 4th 1736   then the above & within Acco.t was Setled and adjudged by and Between Dunkin Murray
and Richard Allison and there remains due from said Allison to Murray Eleven pounds Seven Shillings & [illegible] as
wittness our hands                                                                                             Richard Allison

    Whereupon Came hereinto Court Edward Rownds of Somerset County Gent and undertook
and Assumed upon himselfe for the Same Richard Allison and Eliz.a his wife (Likewise the said
Richard Allison present here in Court in his proper person Assumed upon himselfe) that if it
should Happen that the said Duncan Murray should recover Judgm.t in the plea afd against
him the said Richard Allison and Eliz.a his wife in the Same Court or that the Same Richard Allison and
Eliz.a his wife Should be therein Convicted that then they the Said Rich.d Allison and Eliz.a should pay
the Judgmt of the Court thereupon or that he the said Edw.d Rownd will do the same for them &c

          Whereupon the same Richard Allison and Eliz.a his wife by William Beckingham their
Attorney Come and defend the force and Injury when &c and pray Leave thereof to Imparle here untill
next Court and they have it and the Same day is Given to the afd Duncan here also &c

       Att which said next Court to witt the seventeenth day of August Anno Dom one thousand
seven hundred and thirty six Came again as well the afd Duncan Murray as the afd Richard
Ellison & Eliza his wife by their attorneys afd  And Whereupon the same Richard Ellison and
Eliza his wife pray further Leave thereof to Imparle here untill next Court and they have it
and the same day is given to the afd Duncan Murray here also &c

       Att which said next Court to witt the Sixteenth day of Novem Anno Dom one thousand
seven hundred and thirty six Came again as well the afd Duncan Murray as the afd Richard
Ellison & Eliz.a his wife by their attorneys afd and whereupon the Same Duncan prays that the
afd Richard and Eliz.a to his declaration afd may answer but the Same Richard and Eliz.a altho' Solemnly
Called ^came^ not but made default nor says nothing in barr or preclusion of the action afd of the same Duncan by
which the Same Duncan remains against the said Rich.d and Eliz.a thereof undefended   for which Cause the same
Duncan his Damages by Occasion of the non performance of the promise & assumption afd against the afd Richd
