County Court of Somerset to be held at dividing Creek in the Same County ^the third Tuesday of august then next^ to answer unto his ^said^ Lordship the Lord Proprietary of a plea that he render unto him Twenty pounds Sterling which to the same Lord Proprietary he oweth & unjustly detaineth &c and that thereof he Should not fail &c Att which said Third Tuesday of August to witt the Seventeenth day of the Same month anno Dom one thousand Seven hundred and thirty Six being the day of the return of the said Writt Came the said Lord Proprietary by William Goldsborough his attorney and the Sheriffe of Somerset County to witt Joseph McClester Gent Likewise Came and made Return that by vertue of the writt afd to him thereof directed had taken the body of the said Daniel Coe whose body before the Justices of his Lordships County Court of Somerset at the same day and place in the writt afd mentioned he had there ready &c Whereupon Came hereinto Court Thomas Predix and Avery Morgan both of Somerset County planters and undertook and Each of them undertook and assumed upon themselves for the same Daniel Coe Likewise the same Daniel Coe present herein Court in his proper person assumed upon himselfe that if it should happen that the said Lord Proprietor should recover Judgment in the plea afd against the said Daniel Coe in the same Court or that the same Daniel Coe should be therein Convicted that then he the said Daniel Coe should pay the Judgmt of the Court thereupon unto the said Lord Proprietary or render his body in Execution of Such Judgment to the prison of the Sheriffe of Somerset ^County^ in Satisfaction thereof or that they ^the^ said Thomas Predix and Avery Morgan will do the same for him And Whereupon the afd Daniel Coe by George Douglas his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to his said Lordship the Lord Proprietary here also &c Att which said next Court to witt the Sixteenth day of November anno Dom One thousand Seven hundred and thirty Six Came againe as well the said Lordship the Lord Proprietary his attorney afd as the said Daniel Coe by his attorney afd and whereupon his said Lordship the Lord proprietary by his attorney and Confesseth himselfe herein Court that he will noe further prosecute against the afd Daniel Coe in the plea afd Therefore the Same deft goe thereof without day &c |
