GD  Avery Morgan

    Command was given to the Sheriffe of Somerset County that he Should
take Avery Morgan Late of Somerset County planter Otherwise Called Avery
                         Morgan if he Should be found in his bailywick and him should Safe keep so that he
might have his body before the Justices of his Lordships County Court of Somerset to be held at
dividing Creek in the Same County the third Tuesday of August then next to answer unto
his said Lordship the Lord Proprietary of a plea that he render unto him Twenty pounds
sterling which unto the said Lord Proprietary he oweth & unjustly detaineth &c and that thereof
he Should not fail &c
                                              Att which said third tuesday of August to witt the Seventeenth
day of the same month anno Dom One thousand Seven hundred and thirty six being
the day of the return of the said Writt Came the said Lord Proprietor by William Goldsborough
his attorney and the Sheriffe of Somerset County to witt Joseph MaClester Gent to whom the
foregoing writt was directed Likewise Cometh and made return that by vertue of the writt afd
to him thereof Directed he had taken the body of the said Avery Morgan whose body before the
Justices of his Lordships County Court of Somerset at the Same day and place in the writt afd mentioned
he had there ready &c
                                                    Whereupon Came here into Court Thomas Predix and Daniel
Coe of Somerset County planters and undertook and Each of them undertook and assumed
upon themselves for the same Avery Morgan (Likwise the said Avery Morgan Present
herein Court in his proper person Assumed upon himselfe) that if it Should happen that
the said Lord Proprietary should recover Judgment in the plea afd against him the said
Avery Morgan in the Same Court or that the same Avery Morgan should be therein Convicted
that then he the said Avery Morgan should pray the Judgm.t of the Court thereupon unto
the said Lord Proprietor or render his body in Execution of Such Judgment to the prison of
the Sheriffe of Somerset County in Satisfaction thereof or that they the said Thomas Predix &
Daniell Coe will do the same for him &c

      Whereupon the afd Avery Morgan by George Douglas his attorney Comes and defends the
force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and
he hath it and the same day is given to his said Lordship here also &c

Att which said next Court ot witt the Sixteenth day of November anno Dom one thousand
Seven hundred and thirty Six Came again as well the afd Lord Proprietary by his attorny
afd as the said Avery Morgan by his attorney afd and whereupon his said Lordship the Lord proprietary
by his attorney and Confesseth himselfe herein Court that he will no further prosecute ag.t the
afd Avery Morgan in the plea afd     Therefore the Same Avery Morgan goe thereof without day &c
