of Somerset to be held at dividing Creek in the Same County the third Tuesday of august then next to answer unto Joseph MccClester of a plea of trespass upon the Case &c and that thereof he should not fail &c Att which said third Tuesday of August to witt the Seventeenth day of the Same month anno Dom one thousand Seven hundred and thirty Six being the day of the return of the said Writt Came the said Joseph McClester by William Beckingham his attorney and the Coroners of Somerset County to witt Henry Ballard Gent Likewise Came and made return that by vertue of the writt afd to him thereof directed he had taken the body of the afd Henry Hazzard whose body before the Justices of his Lordships County Court of Somerset at the same day and place in the writt afd mentioned he had there ready &c And the afd Henry Hazzard by George Douglas his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court ^and he hath it^ and the same day is given to the afd Joseph here also &c Att which said next Court to witt the Sixteenth day of November anno Dom one thousand Seven hundred and thirty Six Came againe as well the afd Joseph MccClester as the afd Henry Hazzard by their attorneys afd and because the afd Joseph MccClester did not declare against the afd Henry Hazzard by the twentieth day of January then next following nor prosecutes his writt afd Therefore he and his pledges of prosecuting be in mercy and the plft name pledges &c and that the afd Henry Hazzard go thereof without day also it is Considered that the afd Henry Hazzard recover against the afd Joseph MccClester his damages by occasion of the premisses to One hundred and Sixty one 161 pounds of tobacco to the Same Henry Hazzard by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the statute in such Case Lately made and provided by the Court here adjudged &c
have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same Court the third Tuesday of August then next to answer unto John Shiles sen.r of a plea of trespass upon the Case &c and that thereof he Should not fail &c Att which said third tuesday |
