289 161 his damages ^by^ occasion of the premisses to One hundred and Sixty One pounds of tobacco to the same Wonney by discretion of the Justices here at his request for his Costs and Charges in that part Sustained adjudged according to the form of the Statute in Such Case Lately made and provided by the Court here adjudged &c
found in his bailywick and him should safe keep so that he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of August then next to answer unto William Colebourn of a plea that he render unto him Two hundred and Seven pounds ninteen Shillings and Two pence Curr.t money of Maryland and four hundred and Seventy Eight pounds of tobacco which to him he Oweth and unjustly detaineth &c and that thereof he should not fail &c Att which said third Tuesday of August to witt the Seventeenth day of the Same month anno Dom One thousand seven hundred and thirty Six Com being the day of the return of the said Writt Cometh the said William Colebourn by Francis Allen his attorney and the sheriff of Somerset County to witt Joseph MccClester Gent Likewise Came and made returne that by vertue of the writt afd to him thereof directed he had taken the body of the afd Henry Miles whose body before the Justices of his Lordships County Court of Somerset at the Same day and place in the writt afd mentioned he had there ready &c And the the afd Henry Miles by William Beckingham his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd William Herealso &c Att which said next Court to witt the Sixteenth day of November anno Dom One thousand seven hundred and thirty Six Came againe as well the the afd William Colebourn as the afd Henry Miles by their attorneys afd and the aforesaid William Coleburn who offered his writt aforesaid against the Same Henry Miles did not prosecute the Same writt with Effect &ca Therefore he and his pledges of prosecuting be in mercy and Lett the plft name pledges &.c and that the afd Henry Goe thereof without Day also it is Considered that the afd Henry Miles Recover against the afd William Colebourn his damages by occasion 310 of the premisses to Three hundred and Ten pounds of tobacco to the Same Henry by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the Statute in such Case made and provided by the Court here adjudged &c |
