288 five years of their abouts being sworn on the holy evangelist of almighty God saith that the above said tree mentioned in the deposition of Thomas Rencher was what he allways reconed to the first bounder of his land Called hickory Ridge and never heard any dispute till since he parted with the said land unto Thomas Willing and further this deponant saith not in testimoney whereof he hath set his hand and seal this second day of November one thousand seven hundred and thirty six John Shiles (seal) In Obedience to the ^above^ Commission we do certify that we have been on the ^said^ Land above mentioned and taken the severall depositions according to the direction of the abovesaid Commisison in testimoney whereof we have set our hands and seals this second day of November one thousand seven hundred and thirty six Day Scott (seal) Geo: Dashiell (seal)
County the third Tuesday of August then next to answer unto John Shiles Senr of a plea of Trespass upon the Case &c and that thereof he Should not fail &c Att which said third Tuesday of Aug.t to witt the seventeenth day of the month ^same month^ anno Dom One thousand seven hundred and thirty Six being the day of the return of the said Writt Comes the said John Shiles by Thomas Bluet his attorney and the sheriff of Somerset County to witt Joseph MccClester Gent Likewise Came and returned by vertue of the writt afd to him directed he had taken the body of the afd Wonney MccClemmey whos body before the Justices of his Lordships County Court of Somerset at the Same day and place in the writt afd mentioned he had there ready &c And the afd Woney MccClemmy by George Douglas his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd John herealso &c Att which said next Court to witt the sixteenth day of November ann Dom One thousand seven hundred and thirty Six Came againe as well the afd John Shiles as the afd Wonney MccClemmey by their attornys afd and because the afd John Shiles did not declare against the afd Wonney MccClemmey by the Twentieth day of January then next following nor prosecutes his writt afd Therefore he and his pledges of Prosecuting be in mercy and the plft name pledges &c and that the afd Woney McClemmey go thereof without day Also it is Considered that the afd Woney MccClemmey Recover against the afd John Shiles sen.r his |
