at dividing Creek in the same County twelve &c by whom &c and who neither &c to recognize
&c because as well &c and afterwards Immediately Came thereof the Jury &c and the Jurors
of that Same Jury by Joseph McClester Gent sheriffe of the County afd to this Impannelled
being Called came to witt David Polk Robert Mitchell Benjn Tull Thomas Winder John Kellum
John Roach William Kitchen WIlliam Porter Huett Nutter Wm Gray Robert Hall and
William Draper who to say the truth of the premisses afd being duely Elected tryed and
Sworn to say the truth of the premisses afd being duely elected tryed and Sworn upon their oath
did Say that the afd Thomas Adams did assume upon himselfe in manner and form as the
afd William Holland William Perkins and Tabitha his wife above against him have Complained
and assessed the damages of the Same William Holland William Perkins and Tabitha
his wife by occasion of the non performance of the promise and assumption afd ^further than his Costs and Charges^ to four
pounds four shillings Currant money of Maryland and for those Costs and Charges to one pds of
tobacco
                                     Therefore it is Considered that the aforesaid William Holland W.m
Perkins and Tabitha his wife Executors of John Holland ^afd^ dec.d recover against the afd
Thomas Adams his damages afd by the Jurors afd in form afd assessed also Eight hundred
and Seventy One                           pounds of tobacco for his Costs and Charges afd to
the af William Holland W.m Perkins and Tabitha his wife of his assent of his assent
of Increase adjudged which Certain damages in the whole do amount to four pounds four
Shillings Curr.t money of maryland Eight hundred and Seventy One
