283 and the same to the said Executor still to doe doth deny altho thereto on the twenty fifth day of december Anno Dom MDCCXXV at the County afd and often since that time by the said John in his life time and by his said Executor after his death the said Thomas was required whereupon they says they are damnifyed tenn pounds Curr.t money and thereof they bring suit &c Pledges &c Jno Doe R Roe Whereupon at the prayer of the afd William Holland William Perkins and Tabitha his wife Executors as afd prays that the afd Thomas Adams may give Speciall Bail to the action afd which is by the Court hereunto there Granted Thereupon a Certain Isaiah Bredall of Somerset County planter present herein Court in his proper person undertook and assumed upon himselfe (Likewise the said Thomas Adams present herein Court in his proper person assumed upon himself) that if in Case the said William Holland William Perkins & Tabitha his wife should recover Judgmt in the plea afd against the afd Thomas Adams or that the said Thomas Adams should be therein Convicted that then he the said Thomas Adams should pay the Judgm.t of the Court there upon or render his body in Execution of such Judgm.t to the prison of the Sheriffe of Somerset County in Satisfaction thereof or that he the said Isaiah Bredall will do the Same for him &c Whereupon the said Thomas Adams by Francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is Given to the afd William Holland William Perkins and Tabitha his wife here also &c Att which said next Court to witt the seventeenth day of August Anno Dom one thousand seven hundred and thirty six Came againe as well the afd William Holland William Perkins and Tabitha his wife as the afd Thomas Adams by their attorneys afd And Whereupon the same Thomas Adams prays ^further^ Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd William Holland William Perkins and Tabitha his wife here also &c Att which said next Court to witt the sixteenth day of November Anno Dom one thousand seven hundred and thirty six Came againe as well the afd William Holland and Wm Perkins and Tabitha his wife as the afd Thomas Adams by their attorneys afd And whereupon the same Thomas as before defends the force and Injury when &c and saith that he did not assume upon himself to the said John in his life time in manner and forme of the said William Holland William Perkins and Tabitha his wife above against him hath Complained and of this he puts himself upon the Country and the said William Holland and William Perkins and Tabitha his wife in like manner Thereupon it is Commanded that the sheriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordship County Court of Somerset to be held now setting at |
