1736 281 Cometh the said Tabitha Parker by William Beckingham her attorney ^and the sher of somerset County^ to witt Joseph MccClester Gent likewise cometh and returned by Virtue of the Writt afd to him directed he had taken the bodys of the Same James McDonold and Margaret his wife whose bodys before the Justices of his Lordships County Court of Somerset at the same day and place in the writt afd mentioned he had there ready &c And the afd James MccDonnold and Margarett his wife by George Douglas their attorney Cometh & defendeth the force and Injury when &c and pray Leave thereof to Imparle here utnill next Court & they have it and the Same day is given to the afd Tabitha here also &c Att which said next Court to witt the fifteenth day of June anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd Tabitha Parker as the afd James McDonold and Margarett his wife by their attorneys afd and whereupon the Same James McDonold and Margaret his wife pray further Leave thereof to Imparle here untill next Court and they have it and the same day is given to the afd Tabitha here also &c Att which said next Court to witt the Sixteenth day of November anno Dom one thousand Seven hundred and Thirty Six Came againe hereinto Court the afd James McDonold and Margaret his wife by their attorney afd and the afd Tabitha Parker the same day solemnly Called Cometh not nor is her writt afd further prosecuted Therefore she and her pledges of Prosecuting are in mercy thereof without Day Also it is Considered that the afd James MccDonold and Margaret his wife Recover against the afd Tabitha Parker their damages afd by occasion of the premisses afd 231 to Two hundred and Thirty One pounds of tobacco to the Same James and Marg.t by discretion of the Justices here at their request for their Costs and Charges in that part Sustained according to the form of the Statute thereof Lately made and provided by the Court here adjudged &c
