280 And whereupon the said John Follows by Geo: Douglas his attorny complains that whereas a certain William Megraw useing trade and Comerce as ^a^ Merchant according to the Custome of Maryland on the fifteenth day of March Anno Dom seventeen hundred and thirty five at the County afd within the Jurisdiction of this Court made and drew his certain Inland bill of Exchange with his proper hand and name subscribed and directed to the said Thomas Brown then and there likewise using trade and Commerce as a Merchant and by the said bill did request the said Thomas to pay to the said John Follows all such sums of money as the said Thomas then owed him of that years payment both of silver and Gold and paper money and that the said bill should be a discharge to him for the same which said Inland bill of Exchange afterwards to wit the day and year afd at the County afd the afd Thomas did Accept and the same Acceptance on the said Bill Indorsed by his proper hand writing did subscribe by means whereof the said Thomas Brown According to the Custome of Merchants became lyable to answer and satisfy to the said John Follows all such sums of money ^as the said Thomas^ then owed the said William Megraw of the said years payment in silver and Gold and paper money and being so thereof chargeable the said Thomas on Consideration thereof upon himself did assume and to the said John then and there faithfully promise that he the said Thomas would faithfully pay and Content to the said John Follows all such sums of money in silver and Gold and paper money as he the said Thomas and ^owed^ the William Megraw of the said years payment when he should afterward thereof be required and the said John in fact says that he the said Thomas at the time of the drawing and Accepting of the said Inland bill did owe of that years payment the quantity of in silver and Gold and the sum of in paper money Nevertheless the said Thomas his promise and assumption afd in form afd made nothing regarding but minding and fraudulently intending the said John Follows in that part Craftily and subtily to deceive and defraud the said severall sums in silver and Gold and paper money to the said John hath not paid or him for the same in Any sort contented but the same to him to pay hath altogether refused and still doth refuse altho' thereto afterwards to wit on the : : day of : : in the year afd at the County afd and often since that time by the said John Follows required whereupon he the said John says he is the worse twenty pounds Cur.t money of Maryland and thereof he brings suit &c And the afd Thomas Brown by Francis Allen his attorney Cometh and defendeth the force and Injury when &c and prays Leave thereof to Imparle here untill next Court and he hath it and the Same day is given to the afd John Follows here also &c Att which said next Court [illegible] fifteenth day of June Anno Dom One thousand Seven hundred |
