280 Wise in whose possession he then was who refused to deliver him we do also find that the negro devised to Arthur Johnson came to the possession of William Richardson as Executr of the Last Will and Testament of Robert Johnson the devisor that the said devisor by his last will and Testament afd devised a negro woman and her Child to Arthur Johnson who is since deceased intestate that negro in dispute was born whilst the said William Richardson ^was^ possessed of the said Negro woman and that the said William Richardson by his Last Will and testament duly proved and Insinuated dated the tenth day of may Seventeen hundred and Twenty Seven devised the sid negro to his son Samuel in whose right the deft is now of the said Negro possessed which negro is now about sixteen Years of age and was appraised in the Inventory of the said Will.m Richardsons Estate to the Sume of twelve pounds tenn Shillings Curr.t money [illegible] say that the negro in dispute is of the Value of forty pounds Curr.t money [illegible] on the whole matter we pray advisement of the Court in the premisses if [illegible] plft we then say upon our oath that Tho.s Wise doth detaine the Negro Slave Cæsar in the declaration mentioned in Such manner and form as the said David Johnson above against him hath Complained and doe assess damages by occation of the said detainer beyond the [illegible] the said Negro so as afd found to one Shilling Currt money of Maryland beyond his Costs and Charges by him about this Suit Expended and for his said Costs & Charges to One pound of tobacco [illegible] Law be for the deft we say on our Oath that Thomas Wise doth not detaine ye said negro in manner and form as the said David above against him hath Complained and because the Court here (of his Lordship the Lord Proprietary) of their Judgment of and upon the premisses afd to render as yett will advise day thereupon is given to the afd David and Thomas before the Justices of his said Lordships County Court of Somerset to be held at dividing Creek in the Same County untill the third Tuesday of November then next of their Judgment thereupon to hear for that the Court here thereof as Yett &c Att which said next Court to witt the Sixteenth day of November Anno Dom One thousand Seven hundred and thirty Six Came againe as well the afd David as the afd Thomas by their attorneys afd and whereupon all and Singular the premisses by the Court here being seen and fully understood &c Therefore it is Considered that the afd David Johnson administrator of Arthur Johnson [illegible] writt and declaration afd but be in mercy for his false Clamour and that the said Thomas Wise goe thereof without day &c
